ILLUSIVE PRESENTS | TERMS OF SALE

Patrons purchasing tickets to shows presented by Illusive Presents are warned not to buy tickets from unauthorised operators.

Of late, we have been made aware that people are paying excessively inflated prices for tickets to our concerts through unauthorised outlets.

Please refrain from purchasing through such organisations, as neither the Promoter nor the authorised Ticketing Agency are able to assist you or make good any promises that have been made to you by such organisations.

At no time do Illusive Presents allocate tickets to organisations such as www.ticketfinders.com.au, www.worldticketshop.com, or www.viagogo.com.

Should you choose to purchase tickets through such organisations, we are unable to assist you in accessing the event or retrieving your money.

The only way you can be assured of paying the correct prices and actually receiving valid tickets is by purchasing via the venue’s official ticketing agent, as listed on the Illusive Presents website.

If you have any doubts, consult www.frontiertouring.com or www.illusivepresents.com for direct links to the authorised ticketing company of each event.

Please read these Terms Of Sale carefully before purchasing a ticket for any concert/event promoted by Illusive Presents Pty Ltd (“Illusive Presents”). By purchasing a ticket to a concert/event promoted by Illusive Presents (“Illusive Presents Event”) you are agreeing to be bound by the following terms and conditions.

SALE OF TICKETS ONLY THROUGH AUTHORISED AGENTS

Tickets to Illusive Presents events must only be sold through our authorised ticketing agencies (“Illusive Presents Ticketing Agent”).  When purchasing a ticket from a Illusive Presents Ticketing Agent you are agreeing to be bound by these Terms of Sale and any additional terms and conditions of sale imposed by the Illusive Presents Ticketing Agent. If there is any inconsistency between these Terms Of Sale and any terms of the Illusive Presents Ticketing Agent or the Live Performance Australia Code of Practice for Event Ticketing in Australia, these Terms of Sale will prevail.

The promotion, advertising, offering, or selling of tickets to a Illusive Presents Event by anyone other than a Illusive Presents Ticketing Agent, by any forum or outlet (including but not limited to online and offline classified services) whatsoever, is strictly prohibited without Illusive Presents’ prior written consent.

Illusive Presents reserves the right to cancel any ticket it detects as being promoted, advertised, offered or sold in breach of this condition.

SALE OF TICKETS ONLY AT RECOMMENDED RETAIL PRICE

Selling any ticket to a Illusive Presents Event for an amount greater than Illusive Presents’ advertised retail price is strictly prohibited without Illusive Presents’ prior written permission.

Illusive Presents reserves the right to cancel any tickets it detects as being promoted, advertised, offered or sold in breach of this condition.

Tickets may not, without the prior written consent of Illusive Presents, be used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. In addition to any other legal rights and remedies that Illusive Presents has in this regard, Illusive Presents has the right to immediately cancel, without notice or compensation to the ticketholder, any tickets sold or used in breach of this condition.

THE EVENT

Illusive Presents has the right to include additional specific conditions in relation to a particular  Illusive Presents Event. Such additional conditions will be made available either on Illusive Presents’ website and/or on the Illusive Presents Ticketing Agent’s website, or on the ticket, in relation to the particular Illusive Presents Event and will be deemed to be incorporated into these Terms of Sale immediately once such additional term is published.

Illusive Presents has the right to add, withdraw, reschedule or substitute support artists and/or vary advertised programs, prices, venues, seating arrangements and audience capacity without notice to the ticketholder.

Cameras, audio and video recorders may not be permitted to a Illusive Presents Event.    The right is reserved to broadcast or telecast any Illusive Presents Event and if you are photographed, filmed or taped whilst attending a Illusive Presents Event you consent to Illusive Presents or third parties appointed by Illusive Presents photographing, filming or taping you. Third parties appointed by Illusive Presents can broadcast, publish, license and use any photographs, film, recordings or images of you without compensation. Illusive Presents, the third parties and anyone acquiring from them a right to use the material are not liable to you in any way for its use.

To the extent permitted by the law and subject to your rights under any applicable Consumer Guarantees in the Australian Consumer Law, you release Illusive Presents (including its directors, officers, employees, consultants, contractors, agents and volunteers) from any liability for any damage, loss, liability or injury you may suffer in relation to your attendance at a Illusive Presents Event, howsoever caused, including due to any negligence or other act or omission of Illusive Presents.

You agree to compensate Illusive Presents for any damage, loss, liability or injury Illusive Presents may suffer as a result of your wilful, reckless or negligent acts or omissions at a Illusive Presents Event.

RIGHT TO REFUSE ENTRY TO ILLUSIVE PRESENTS EVENT

Illusive Presents’ rights to refuse Entry to a Illusive Presents event include but are not limited to:

(a)    if the ticketholder’s ticket has been cancelled or is not valid (including but not limited to tickets that have been cancelled because they were sold by an unauthorised seller or at an inflated price in breach of these Terms); or

(b)     if the ticketholder’s ticket is defaced or damaged.

Illusive Presents may impose specific additional conditions in relation to the entry to a particular Illusive Presents Event.

Ticketholders are reminded that in addition to Illusive Presents’ rights to refuse entry to a Illusive Presents Event, the venues hosting such Illusive Presents Event may impose additional restrictions.

CANCELLED OR RESCHEDULED ILLUSIVE PRESENTS EVENTS

If the Illusive Presents Event is rescheduled for any reason whatsoever, the ticket will be valid for the rescheduled event. The ticketholder is entitled to a full refund if the ticketholder cannot, or does not wish to, attend the rescheduled event PROVIDED THAT the ticketholder applies for the refund within the reasonable period of time advertised or notified by Illusive Presents and/or the relevant ticketing agency.

If the Illusive Presents Event is cancelled for any reason whatsoever, the ticketholder will be entitled to a full refund of the ticket price.

To avoid doubt, Illusive Presents is not liable to the ticketholder for any losses or expenses incurred in connection with a Illusive Presents Event being cancelled, postponed or changed, (including, for example, travel, accommodation or other ancillary expenses), except to the extent that such losses arise from Illusive Presents’ breach of an applicable Consumer Guarantee (set out in the Australian Consumer Law).

REPLACEMENT TICKETS

Refunds or exchanges on any ticket will only be given as set out in these Terms of Sale, as set out in the Live Performance Australia Code of Practice for Event Ticketing in Australia or where required under the Australian Consumer Law (or any other applicable laws).

Illusive Presents Ticketing Agents may charge a fee for the replacement of tickets.

Illusive Presents will not issue replacement tickets where seating is not allocated (general admission tickets).

VARIATION TO TERMS OF SALE

Illusive Presents may vary these Terms Of Sale at any time. Any variations become effective immediately once the variation is published.
